Agreement and Platform Scope

These Terms of Service govern access to Ziplytica's platform, including territory management, lead workflows, billing, and contact-enrichment features. By creating an account, purchasing a subscription, or using enrichment features, you agree to these terms on behalf of yourself and the business entity you represent.

Ziplytica provides lead-intelligence and workflow tooling for authorized business users. Contact enrichment is offered inside the platform and does not guarantee complete, accurate, or current contact data.

If you have a signed order form, master services agreement, or enterprise addendum with Ziplytica, that signed agreement controls where it conflicts with this summary.

Authorized Use and Account Controls

You may use the platform only for lawful business purposes consistent with your subscription tier, territory rights, and applicable law.

You are responsible for all activity under your account, including activity by agents, contractors, and other authorized users you permit to access the platform.

Each authorized user must be at least 18 years old, bound by terms at least as restrictive as these Terms, and removed from access promptly when their relationship with your organization ends or misuse is suspected.

Contact Enrichment Terms

A credit is charged only when Ziplytica successfully returns usable contact-enrichment data through the active runtime flow, unless your plan or order form states otherwise.

No-credit outcomes include no-contact-found results, provider failures, and internal temporary issues where the platform explicitly reports that no credit was deducted.

Previously unlocked data for the same brokerage and lead may be returned from platform records without a new provider lookup.

Enrichment data is licensed for your internal business use inside the platform only. You may not resell, sublicense, syndicate, bulk-export, scrape, mirror, or redistribute enrichment data or provider outputs except as expressly authorized in writing by Ziplytica.

Third-Party Data License Conditions

Contact enrichment may rely on data licensed to Ziplytica from third-party providers. Your use of enrichment results is subject to the restrictions those providers impose on Ziplytica, including prohibitions on resale, bulk transfer, database reconstruction, AI training, and use outside permitted business purposes.

Those data licensors may be third-party beneficiaries of restrictions that apply to your use of enrichment data and may enforce applicable use restrictions directly where permitted by contract.

You must not remove, obscure, or misrepresent proprietary notices associated with licensed data where they appear in platform outputs, and you must not disclose provider names or source attribution beyond what is required by law, privacy notices, or your agreement with Ziplytica.

Prohibited Uses

You may not use enrichment data or platform outputs for consumer-report purposes under the Fair Credit Reporting Act, including credit, insurance, employment, tenant screening, housing eligibility, or similar regulated decisioning.

You may not use the platform or enrichment data for stalking, harassment, surveillance, domestic-violence-related location, or contact with individuals protected by Daniel's Law or comparable covered-person statutes.

You may not use enrichment data in violation of the Driver's Privacy Protection Act, Gramm-Leach-Bliley pretexting rules, HIPAA-regulated workflows, or laws prohibiting discriminatory or unlawful automated decisioning.

You may not use returned contact data for unlawful harassment, deceptive practices, or outreach that violates TCPA, federal or state do-not-call rules, CAN-SPAM, privacy laws, or consumer-protection rules.

Outreach, TCPA, and Do-Not-Call Obligations

Enrichment data does not include, constitute, or evidence consent for calls, texts, emails, ringless voicemail, prerecorded messages, autodialed communications, telemarketing, or other solicitation.

You are solely responsible for determining whether and how returned contact data may be used for calls, texts, emails, direct mail, postcards, handwritten letters, or automated workflows.

Before outreach, you must maintain lawful bases, consent records where required, internal suppression lists, federal and state do-not-call compliance, opt-out handling, and manual review appropriate to your campaign type.

Compliance flags or risk indicators displayed in the platform are assistive only and do not replace your independent legal review or suppression workflow.

Data Accuracy and Verification

Enrichment data may be derived from public records and third-party sources with varying accuracy, completeness, and currency. You assume the risk of relying on returned data without independent verification.

You must verify identity, property association, and contact plausibility before outreach or regulated use. Ziplytica does not warrant that returned data is current, reachable, or lawfully contactable.

Suppression, Privacy Requests, and Downstream Flow-Down

You must honor suppression, deletion, opt-out, and do-not-contact instructions applicable to enrichment data you receive or use, and propagate those instructions to anyone in your organization who receives the data through your account.

If you receive a privacy, deletion, correction, opt-out, or do-not-contact request relating to data obtained through Ziplytica, you must notify Ziplytica promptly and cooperate with remediation steps we or our providers require.

You must not contact, attempt to contact, or further disclose any individual after a valid suppression or takedown instruction applies to your use of that data.

Operational Limits and Enforcement

Ziplytica may suspend or limit enrichment functionality during provider outages, abuse events, billing disputes, security incidents, or legal or compliance review.

Platform features, provider routing, response formatting, and compliance controls may change as reliability, security, and legal requirements evolve.

Material breach of these enrichment restrictions may result in immediate suspension, termination, credit forfeiture where permitted by law, and liability for damages permitted under applicable agreements.

Support, Billing, and Disputes

Billing and access disputes are evaluated using platform operational records, including credit ledgers, access records, and request identifiers.

Report inaccurate data, disputed charges, or suspected misuse through support as soon as practical after discovery.
